Lawsuit Filed Over Fatal Monongalia County Accident

Charlotte Cain recently pleaded guilty in the death of Dennis Thomas.

MORGANTOWN -- A woman whose husband died after a 2008 traffic accident, is suing the woman convicted of causing his death.

Dennis Thomas, a retired educator, died after Charlotte Cain's car hit the back of his tractor, on Route 7 near Wadestown, in August 2008.

The tractor rolled over and crushed him.

Cain pleaded guilty to negligent homicide and Rose Thomas is using that as a basis in her civil suit against Cain.

Thomas is seeking damages for medical costs, lost wages, and more.

After the guilty plea, Cain was sentenced to one year home confinement. She will also have to pay restitution.

Most automobile "accidents" are not accidents at all but complete negligence. Sue them for everything they have!!!! If the criminal justice system wont do anything then use the civil justice system.

I was involved in a similar accident some years back where my husband fell asleep at the wheel. We both suffered injuries from the accident & it very well could have been fatal for either one or both of us. I know that had the accident turned out to be fatal for me & my husband would have survived that my family would have never thought of filing a lawsuit against him. I just wonder if it was a family member that had caused this terrible accident if there would still be a lawsuit. I did not even realize my husband was that tired when our accident occured & afterwards he told me he didn't even remember feeling tired. It just happened. I know that driving while tired is being irresponsible, but I can tell you that I don't know anyone, myself included, that hasn't done something at some point that could be considered irresponsible while behind the wheel that could have resulted in a terrible accident.

Renee I dont know you but I do know of this accident. And some of the statements you made are not true and you know that... I have never lost or never want to lose a child and I can not even imagine the pain you all live threw.. But please dont post such false statements...

To all of you: Here is my story, I'll make it as short as possible. On November 25, 2005 my son, Kyle and his friend Dennis were killed in a car accident in Clarksburg. The person that collided with my son was not wearing a seat belt, got out of his truck and kicked the gravel as Dennis laid there already gone and Kyle was being flown to Ruby, where he later passed away. There was no alcohol involved and no one fell asleep, just a terrible, terrible accident. Do I want money? no, Do I want to punch the creep in the face as hard as I can? you bet, but I know that both of these young men we lost that horrific day were better than that and someday that person, I won't say his name, will have to answer to God. That person has children and I can only hope he never has to walk in the same shoes I and Dennis's mom have to each and every day for the rest of our lives. Time does not heal this kind of pain. So we go on and we cry at the memories and we smile at the memories. And that person?, well who cares...someday I'll see him in person and he knows who he is and he has to live with what he did EVERY DAY...just sign me Kyle's mama

You all must not know Mrs. Thomas well enough. She is the last person that should be called greedy. She is a wonderful lady who is respected through out the community of Wadestown. Get your facts straight before you bad mouth the innocent.

WOW, you really have no idea. For someone that has a college education and had a job with the same company for over 10 years and that does not receive welfare I hardly say that is trash. Get your facts straight before you comment.

For someone that has nothing that means TRASH to me....And I corrected my spelling IDIOT....Make her go out and get 1, 2, or more jobs and get off welfare and stop wasting my tax paying dollars...And pay for the DEATH she caused... She is uselss in my eyes and alot of other peoples eyes.. Say all the hateful things you want to me I dont give a crap.. I call them as I see them and she is TRASH....

Apparently you do not know Cain because she DOSEN"T HAVE ANYTHING. And the only piece of trash here is the ones that think they can get everything handed to them on a gold platter. Maybe you should go back to school and learn to spell.

You all are a bunch of idiots... This family needs to sue Cain for everything she has.. She chose to get behind the wheel knowing she was so tired she couldnt keep her eyes open...Wait till you all lose a family memember to a peice of trash then you will thing again...YOu GO MRS. THOMAS YOU GET EVERY DIME YOU DESERVE...

The only thing that is wrong with this world is people like this. Just because something bad happened to them they think they are going to get rich. Well wake up and smell the coffee. He was retired so therefore there is no lost wages his retirement became hers. Secondly the person that plead quilty was quilty because she feel asleep at the wheel. She was not under the influence of anything only what was prescribed by a physican which was in legal limits of when the accident happened. And what does Mrs. Thomas think she is going to get from someone that has absolutely nothing. She lost her job, vehicle, every penny that she had because of this accident. So she needs to take what the insurance has aggreed on and get on with her life. Why waste more money on attorney fees ect and put it at rest.

I am sure the fact that the lawyer got a percentage of your compensation had absolutely nothing to do with their advice to sue for "... everything that stupid fool and his family will ever own in this world..." I agree with Don't be Greedy. If a law suit is the only way to receive compensation, you should only sue for what is needed. This would be lost wages, medical bills, etc. You should not sue to get rich. Also, as far as your attorney's comment goes, what did this person's family do to you or the attorney? Why should they suffer? Being that he was a teenager, I realize that suing his family was your only recourse, but for the way your attorney put it? Your attorney saw $$$ and that was it. This is why we need an overhaul of the legal system.

This comment is in no way directed at Mrs. Thomas, as I have little information of the situation.

Indeed ... Suing is often the only answer! After the loss of my spouse to an intoxicated teen-age driver, my attorney advised a wrongful death suit in the amount of "...everything that stupid fool and his family will ever own in this world..." After 8 years, the compensation payments are still being received. I know the "value" of the life partner I lost. I have no idea what suffering or hardship the other party has to endure for this, nor do I care to know. The monetary compensation was determined by the litigation process. For that process, I have no regrets !!!

I feel for the family and their loss, however suing is not always the answer. The victim's family is entitled to compensation from the victim compensation fund. It covers up to $100,000. I hope the family gets the monetary compensation that they NEED and nothing more. I am a victim myself and hope the family is not using the victim status to get money it will just devalue the life of the person who lost his life.

Mrs. Thomas, my heart goes out to you and your family... I hope you get everything that you are suing for...And for Cain to get only a year of home confinement is just down right crap..She should be in prison...
