BUCKHANNON -- The Upshur County man accused of shaking his six-week-old baby causing brain damage and ultimately its death was back in court Tuesday.

Attorneys have selected a jury for Sonny Alloway's trial. Alloway is charged with child abuse resulting in death.

Prosecutors say Alloway shook his son Damien so severely that the boy suffered major brain damage.

The State Medical Examiner has ruled that the baby's cause of death as a result of physical abuse.

Alloway has another child, a twin brother to Damien. A condition of his home confinement said that Alloway could not be around his children.

Alloway was arrested in November 2005. His trial has been delayed twice. The trial is currently scheduled to begin on Feb. 5.
